Located the problem, the reason i was getting access denied was that I needed to change the autority of the object in the CL program, by adding teh following code after the CPYTOSTMF section it allw orked beautifully:
CHGAUT OBJ(&PATH) USER(*PUBLIC) DTAAUT(*RWX) OBJAUT(*ALL)
